How a Solar Permit Became a Data Center Deal

The land in question was originally approved in 2023 for a solar energy project. The permit holder, Townsite Solar 2, is controlled by a Texas investment fund. Late last year, the company returned to BLM and indicated it no longer intended to build the solar project the public had been informed about. Instead, it sought to construct a 170-megawatt AI data center on the same parcel.

A solar field and a data center are not equivalent types of development. Their infrastructure footprints, energy demands, water consumption profiles, and community impacts differ substantially. The location compounds the controversy. The Mojave Desert sits within a region already grappling with shrinking reservoirs, stressed electrical infrastructure, and calls for residents to conserve water. AI data centers are among the most energy- and water-intensive industrial facilities in modern construction. According to Fortune, data centers use high amounts of water and electricity — resources under acute pressure across the Southwest.

Nevada has also offered tax abatements to the data center industry, and the local utility is reported to be preparing to spend billions constructing new gas turbines to meet the electricity demands these facilities will generate. The cost of that infrastructure investment will flow through to ratepayers — residents and businesses who had no seat at the table when the original land-use decision was made.

House appropriators reviewing similar federal land data center projects elsewhere have acknowledged that the military and federal push to host commercial data centers on public land places, in their words, “significant strain on energy and water resources” and that “communities have resisted such projects,” according to Federal News Network reporting on Congressional scrutiny of Pentagon AI data center plans.

National Polling and Local Opposition

The Boulder City situation is not an isolated case of community resistance. The Army has selected the Carlyle Group — described by Federal News Network as one of the world’s largest private equity firms — to build a data center at Fort Bliss in Texas. CyrusOne, jointly owned by KKR and BlackRock, has been selected to develop a similar project at Dugway Proving Ground in Utah. The Air Force is opening unused land across five military bases to private companies for AI data center construction.

Congress has begun pushing back, at least on the margins. Representative Cory Mills (R-Fla.) secured a provision in the House Armed Services Committee’s version of the fiscal 2027 defense authorization bill that would bar the Defense Department from leasing land to companies whose data center equipment contains components manufactured by U.S. adversaries. The Army, however, characterized the measure as creating a “federal land penalty” and an “unworkable standard” that would drive away private capital.

Representative Rashida Tlaib (D-Mich.) introduced related scrutiny measures, while House appropriators directed the Defense Secretary to assess how proposed data center projects could impact nearby communities before construction begins — examining energy and grid demands, water and environmental impacts, physical security implications, and cumulative community effects.

Eminent Domain Enters the Picture

Where federal land isn’t available, private landowners are facing a different form of pressure. Fortune reports that power companies are invoking eminent domain — the government’s inherent power to seize private property without a landowner’s consent — to acquire land for transmission lines needed to deliver electricity to data centers. The legal and ethical questions surrounding whether eminent domain appropriately applies when the ultimate beneficiary is a private commercial data center, rather than a traditional public utility, remain unsettled.

The Structural Question

What happened in Boulder City fits a recognizable pattern: public assets transferred to private interests, costs distributed across communities and ratepayers, benefits concentrated in the hands of investment funds and technology companies, and the decision-making process insulated from the public whose land and infrastructure are being committed.

The mechanism used — allowing a permit holder to substantially change the nature of an approved project without triggering fresh public review — is precisely what critics argue sets the dangerous precedent. If the Boulder City approval stands, it creates a template. A project can be approved as one thing, then transformed into something categorically different, with no meaningful opportunity for the surrounding community to weigh in on what their public land is actually being used for.
